Terms of Service

These Terms of Service ("Terms") govern your use of the SPOT mobile application and related services (the "App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Who can use the App
You must be at least 17 years old, consistent with the App's App Store age rating, or older where your country requires. If you are under the age of majority, you must have a parent or guardian's permission.
2. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, for your own personal, non-commercial use, subject to these Terms and the End User License Agreement and the Apple Media Services Terms and Conditions.
3. What SPOT does
SPOT builds personalized plans for a night out, a day, a weekend, or a trip. Using your brief (vibe, timing, budget, who is going, dietary needs, must-sees) and your taste profile, it assembles a plan from real, map-verified places, in an order that flows, with honest walking and transit times. Planning runs on your device on Apple-Intelligence iPhones and, for some plans, through a privacy-preserving cloud relay. SPOT can read your calendar to plan around commitments, add stops to your calendar, send reminders, import saved places from Instagram and TikTok, and store your plans and preferences on your device and in your iCloud. Features may change over time.
4. Your content
Preferences, notes, plans, saved places, and other content you create or import ("Your Content") belong to you. You are responsible for Your Content and for having the right to use any place or material you import. We do not claim ownership of Your Content. You grant us only the limited permission needed to operate the features you use (for example, sending your planning request to our processing service to build a plan, as described in our Privacy Policy).
5. SPOT+ (subscriptions)
Some features are part of SPOT+, available as a monthly auto-renewing subscription and an annual auto-renewing subscription. Current pricing is shown in the App and on the App Store and may change. Prices are set per region and are inclusive of applicable taxes where required.
Billing and auto-renewal. Subscriptions are billed through your Apple ID at confirmation of purchase. Auto-renewing subscriptions renew automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends. Any free trial or introductory offer, if provided, is described at the point of purchase; unused trial time is forfeited when you purchase a subscription.
Managing and canceling. You manage and cancel subscriptions in your Apple ID settings (Settings → [your name] → Subscriptions), not in the App. Deleting the App does not cancel a subscription.
Refunds. Purchases are processed by Apple and are subject to Apple's refund policies. We generally cannot issue refunds directly; please request them through Apple.
Restore. You can restore previous purchases from within the App using the same Apple ID.
6. Acceptable use
You agree not to: use the App for any unlawful purpose; reverse engineer, decompile, or tamper with the App except as permitted by law; disrupt or attempt to gain unauthorized access to our services; or use the App to infringe anyone's rights.
7. AI features
SPOT's plans and suggestions are generated automatically, on your device and, for some plans, by our cloud AI provider. They can be wrong, incomplete, or out of date. Treat them as ideas, not instructions. They are not professional travel, safety, medical, or dietary advice. Always use your own judgment and verify details before you rely on them.
8. Places, hours, and recommendations
Venue details, opening hours, routes, prices, and other recommendations in the App are a convenience drawn from third-party map and web data together with automated intelligence, not verified facts, and may be inaccurate or out of date. They are not a guarantee that a place is open, available, safe, or suitable for you. Hours, prices, and conditions change; always verify directly with the venue and use your own judgment. We are not responsible for reliance on any recommendation.
9. Third-party services
The App works with services provided by Apple (Maps and MapKit, iCloud, Calendar, the App Store), and uses Open-Meteo, Foursquare, OpenStreetMap, Nager.Date, Unsplash, and Pexels for data and imagery, and Cloudflare and Anthropic to process certain planning requests. Your use of those services is subject to their own terms and policies. We are not responsible for third-party services.
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY RESULT (INCLUDING PLACES, ROUTES, OR AI OUTPUT) WILL BE ACCURATE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GASTRONAUT LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR USD $50, WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Gastronaut Labs from claims arising out of your misuse of the App or violation of these Terms or the rights of others.
13. Termination
You may stop using the App at any time. We may suspend or end the App or your access to it if you violate these Terms or if we discontinue the service. Sections that by their nature should survive (for example, disclaimers, limitation of liability, and governing law) will survive termination.
14. Governing law
These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located there, except where prohibited by law. If you are a consumer, you may have additional rights under the laws of your place of residence.
15. Changes to these Terms
We may update these Terms as the App evolves. We will post the revised Terms here with a new effective date. Continuing to use the App after changes take effect means you accept them.
